Privacy Statement

RAI Vereniging processes personal data of (contact persons of) members, board members, and stakeholders, including interest groups and politicians. We do this with a view to our societal role and to serve our members as best as possible and to achieve our statutory objectives. In this privacy statement, we explain why and how we process personal data, what we do with it, how we provide access, which other parties have access to it, how long we retain it, and how the data is secured.

In accordance with legal requirements, RAI Vereniging has not appointed a Data Protection Officer (DPO), but we are happy to assist you with your questions. Who are we?

RAI Vereniging represents the interests of approximately 700 affiliated manufacturers and importers of passenger cars, vans and trucks, trailers and semi-trailers, bodies and special vehicles, motorcycles, scooters, mopeds and light mopeds, bicycles, automotive suppliers, suppliers of parts and accessories, and garage equipment.

Objectives of RAI Vereniging (as laid down in the statutes)

2.1 The association aims to:

a. contribute to the most favorable business climate possible for its members; b. represent the interests of its members regarding the operation of businesses as manufacturers or importers of, or distributors appointed by the manufacturer of, or wholesalers in: bicycles, mopeds, and motorcycles, passenger and commercial vehicles, special vehicles, buses, bodies, as well as trailers and semi-trailers, caravans and motorhomes, parts and accessories of the aforementioned vehicles, garage tools and equipment, as well as members engaged in the bodywork sector in the areas of manufacturing, maintenance, and repair of bodies, semi-trailers, trailers, buses, special vehicles, and related businesses, and in the area of vehicle conversion and related businesses; and to promote the development of sustainable mobility in the Netherlands.

**2.2 Import

As referred to in this article, also includes the activities of agents who take orders on behalf of manufacturers to have these orders fulfilled by these manufacturers, or to fulfil these orders themselves from their own or consignment stock. Wholesaling, as referred to in this article, also includes the services provided by so-called auto-technical specialists to the categories of customers to whom the wholesaler usually supplies.

2.3 The association strives to achieve its objectives by:

a. holding member meetings to discuss economic, fiscal, and technical subjects and other topics of common interest to the members; b. consulting and informing members regarding the subjects mentioned in point a; c. organizing, directly or indirectly, exhibitions related to the goods mentioned in paragraph 1 of this article; d. expressing the association's views to national and other authorities, institutions, and individuals who influence the policy related to the goods mentioned in paragraph 1 of this article, respecting the freedom of individual members to take their own stance on matters particularly concerning them; e. seeking affiliation with other organizations and institutions at home and abroad that operate in the field of industry, import, and wholesale, as referred to in this article, and entering into agreements with such organizations and institutions; f. establishing and maintaining institutions and organizations that can promote the realization of the pursued objectives; g. representing in public and other bodies or boards whose activities relate to the manufacture or import and use of the goods mentioned in paragraph 1 of this article; h. developing informational and other activities aimed at improving the climate for the use of the goods mentioned in paragraph 1 of this article; i. being represented at conferences and other meetings at home and abroad related to the industry, import, and wholesale of goods mentioned in paragraph 1 of this article; j. publishing one or more association organs; k. setting rules for companies active in the bodywork sector that can promote efficient and responsible business operations by those members; l. promoting business jurisprudence for companies active in the bodywork sector; m. entering into collective labor agreements for companies active in the bodywork sector; n. promoting the education of entrepreneurs whose companies are active in the bodywork sector, as well as promoting vocational training for employees working in these companies.

This privacy statement applies to all processing by RAI Vereniging, even when we process personal data together with other parties (e.g., in the case of an event).

Which personal data do we process?

Members

Company data, first and last names of contact persons, business address details and phone numbers, gender, email address, correspondence and participation details (of events and/or meetings), payment details, areas of interest, function, photos (in historical archive), contact history, IP address, browsing history, social ID, cookie ID (you can read more about cookies in the cookie statement).

Potential members

Company data, first and last names of contact persons, business address details and phone numbers, gender, email address, function, interests.

Politics

First and last names of contact persons such as civil servants, members of parliament, and ministers: business phone number, gender, email address, function, in the case of members of parliament, their faction and work address.

Other stakeholders

First and last names of contact persons, business phone number, gender, email address, function, work address.

Why do we process this personal data? (purposes)

A small part of our processing is legally required. This mainly concerns personal data needed to fulfil our tax obligations, but also, for example, in case of emergencies at RAI Vereniging, in the RAI building.

Member administration and service

In our member administration, we keep track of which organizations are members of RAI Vereniging, along with the relevant contact persons. We keep various personal data of contact persons to perform our services as optimally as possible. For example, we maintain contact details to reach contact persons, interest areas to provide members with the most relevant information, process personal data for market research, and participation details to plan our meetings/events, etc., as best as possible.

You can reach us through various channels: phone, mail, email, Twitter, LinkedIn, and Facebook, etc. To make this possible, we also process personal data. These third parties have access to personal data because they place so-called cookies. For more information, please refer to the privacy statements of these third parties.

Newsletters and e-mailings

You can subscribe to one or more newsletters with us. We can use the email addresses of recipients to collect information about the interests of readers and visitors to our website. This way, we can see if our newsletter links to articles on the website are clicked and recognize users when they log in to our website. This allows us to track the actions recipients take from the email, measure how effective our newsletter is, through which route the website is visited, and how much interest there is in included articles. Such analyses can only be made by authorized employees; interest measurement is not done at an individual level. The legal basis for our analyses is your consent. This consent can always be withdrawn. If you no longer wish to receive newsletters, you can unsubscribe via an unsubscribe link that is under each newsletter. Please note that processing an unsubscribe may not always be immediate, and you may still receive a newsletter.

Recruitment (marketing)

RAI Vereniging moves with the sector, and therefore we recruit new members, speakers for events, experts for inspiration sessions, and sometimes new colleagues. To maintain contact with everyone, we also process their contact details and areas of interest.

Improvement of RAI Vereniging services

For the improvement of our services, we also keep track of personal data. For example, we measure click behaviour on the website to analyze which articles are most read and open rates to see if our newsletters are sufficiently relevant or need adjustment.

Special data

We process two types of special personal data: ethnicity (photos) and political preference. Photos of events and publications are processed in the RAI historical archive. These processes are (of course) not used for other, commercial or non-commercial, purposes; access to this archive is limited to the administrators. We only keep track of political preference for members of parliament, and we use that information to consider when determining the content of our messages to optimally fulfil our role as advocates.

Rights of individuals

Under the GDPR, everyone has a number of rights. We do our utmost to comply with them as well as possible. Do you have tips or comments? Please let us know. Information and access

Of course, you can see what personal data we process about you. If desired, with an explanation of how and why we process that data.

Rectification

Do you think we have incorrect data about you? Let us know, and we will correct it. If an employee or colleague leaves the company, please inform RAI Vereniging. This way, we keep the file up-to-date and correct.

Erasure

You can have the personal data we hold about you deleted. We will comply with this request unless we need to process that data for other purposes (e.g., administration).

Restriction

Do you believe we are processing your personal data unlawfully or incorrectly? Then you can have that processing restricted.

Objection

You can object to the processing of your personal data by RAI Vereniging. If it concerns the use for commercial purposes, we will stop that processing as soon as possible.

Portability

This is a new right under the GDPR to transfer your personal data to another provider of a similar service. If you wish to use this right, please contact us.

RAI Vereniging always offers the possibility to withdraw previously given consent, for example, for receiving e-mailings through the unsubscribe link in those e-mailings. If you want to withdraw your consent for another processing, you can contact us.

File a complaint with the Data Protection Authority

Do you believe we are not acting in accordance with privacy legislation? Please contact us first for a response. After May 25, 2018, you can also file a complaint with the Dutch Data Protection Authority (AP). Before that date, you can only give a tip to the AP by filling out this form.

Retention periods

We do not retain personal data longer than necessary. The duration depends on the specific use of the data. Once retention of data is no longer necessary, such as upon termination of membership, these will be deleted unless a statutory retention period applies.

As explained above, we process data to fulfil a legal obligation, to perform a contract (membership, event), and to fulfil the legitimate interest of RAI Vereniging: achieving our objectives.

Third-party recipients

To perform our services, we engage external service providers. These are not 'third-party recipients' but processors who can only use personal data in a way determined by RAI Vereniging. For example, we use Google Analytics and store contact person data in a CRM from Microsoft. These parties process personal data in accordance with the assignment of RAI Vereniging. Processor agreements have been concluded with these third parties. Sometimes we are legally obliged to provide personal data to third parties, such as the Tax Authority. Outside the processing and legal obligation, we only provide data to third parties after obtaining your explicit consent.

On the websites of RAI Vereniging, there are several references to other websites of organizations. RAI Vereniging is not responsible for how those parties process personal data. For that, you can read the privacy statement of the respective organization.
