The Dutch government must amend the current Warenwetbesluit machines (Commodities Act Decree on Machinery) to align it with the new Machinery Regulation.
What will change with the new Warenwetbesluit Machines 2026?
The Warenwetbesluit Machines 2026 implements the Machinery Regulation and governs, among other things:
- Requirements for manufacturers, distributors, authorised representatives, and importers.
- Procedures for assessing the conformity of machines.
- Designation of EU and Dutch conformity assessment bodies.
- Updated references to other relevant Warenwetbesluiten (for example, those relating to personal protective equipment, lifts, and pressure equipment).
The consequences for manufacturers, distributors, and inspection bodies are directly derived from the Regulation itself.
How can you contribute?
You will have the opportunity to respond to the proposal by emailing postbusmachineverordening op minszw punt nl up to and including 9 February 2026. If possible, please also indicate concretely how the draft text could be improved. After the consultation period and the processing of responses, the decision will be submitted to the Council of State, which will assess whether the decision is sound and will not cause any issues.
After this, the decision will be published and will enter into force on 20 January 2027.
